CREATOR AGREEMENT

1. ACCEPTANCE OF AGREEMENT

This Creator Agreement ("Agreement") establishes the legal terms between SoloFansNetwork ("the Platform", "We", "Us") and you as a content provider ("Creator", "You", "Your").

✅ This Agreement complements our Terms of Service and Privacy Policy. You must read them together.

2. ELIGIBILITY REQUIREMENTS

To be a Creator on SoloFansNetwork, you must:

ü Be at least 18 years old (or the age of majority in your jurisdiction).

ü Provide valid, current government-issued identification to verify your age and identity.

ü Not be legally prohibited from providing services on digital platforms.

ü Accept and comply with the Platform's content policies.

⚠️ You represent and warrant that all information provided is true, complete, and up-to-date. The Platform may request additional verification at any time.

3. CONTENT REVIEW AND APPROVAL

3.1 Review Process

• All content you upload will be reviewed and pre-screened by the Platform before public publication.

• Estimated review time: 24-48 business hours.

3.2 Approval Criteria We reserve the right to reject or remove any content that:

❌ Is illegal under applicable laws

❌ Includes material involving minors (absolute prohibition)

❌ Contains non-consensual acts, real violence, or abuse

❌ Infringes third-party intellectual property rights

❌ Promotes illegal activities, hate speech, or discrimination

❌ Violates the Platform's community guidelines

3.3 Rejection Notification

• If your content is rejected, you will receive a notification with the specific reason.

• You may appeal the decision by contacting: creators@solofansnetwork.com

4. CONTENT OWNERSHIP AND LICENSES

4.1 Your Ownership

• You retain full intellectual property and copyright ownership over original content you create and upload to the Platform.

4.2 License Granted to the Platform

By publishing content, you grant SoloFansNetwork a license that is:

ü Worldwide: Valid in all territories where we operate

ü Non-exclusive: You may license your content to other platforms

ü Royalty-free: No additional payments for license use

ü Transferable: We may sublicense to essential service providers (hosting, CDN, payment processing)

This license allows us to:

• Host, store, and reproduce your content on our servers

• Display and distribute your content to Platform users

• Promote your content within and outside the Platform for marketing purposes

• Monetize your content through subscriptions, tips, and pay-per-unlock payments

4.3 Duration and Revocation

• You may delete your content at any time from your Creator dashboard.

• The license terminates for new content upon deletion, BUT:

- Users who have already purchased or downloaded your content retain access according to their purchase terms.

- Cached copies or technical backups may persist for a reasonable period for operational reasons.

5. CONSENT AND DOCUMENTATION FOR REPRESENTED PERSONS

5.1 Consent Obligation

If your content includes other persons (models, collaborators, etc.), you MUST:

ü Obtain written, free, and informed consent from each person over 18 who appears in identifiable form.

ü The consent must clearly specify:

- Authorization to appear in the content

- Authorization for public distribution on SoloFansNetwork

- Authorization for users to download the content (if applicable)

- Duration of consent and conditions for revocation

5.2 Age and Identity Verification

• You must verify and document that ALL represented persons are over 18 years of age.

• Retain copies of official IDs and consent forms for at least 5 years.

5.3 Document Submission

• You agree to immediately provide consent and verification documents when:

- The Platform requests them for audit or verification

- A competent authority requires them by legal mandate

6. IMAGE AND APPEARANCE CONSENT (FOR YOUR OWN CONTENT)

• By checking the consent box during your Creator registration, you explicitly acknowledge and grant the Platform permission to:

- Use, display, and publicly distribute your image, name, voice, and likeness within the context of the Platform.

- Use your profile and content for SoloFansNetwork promotional purposes (e.g., featured content, marketing campaigns).

• You may revoke this consent for future uses by contacting: privacy@solofansnetwork.com

• Revocation does not affect uses already made in accordance with this Agreement.

7. REVENUE, PAYMENTS, AND REVENUE SHARE STRUCTURE

7.1 Revenue Distribution

• Creators receive 80% of net revenue generated from:

- Fan subscriptions to your profile

- Tips received

- Pay-per-unlock individual posts

- Deals, bundles, and promotional content

• The remaining 20% goes to the Platform to cover:

- Payment processing and gateway fees

- Hosting, bandwidth, and technical infrastructure

- User support, moderation, and security

- Platform development, maintenance, and improvements

- Referral programs and marketing

7.2 Payment Schedule

• Withdrawal frequency: Every 20 days

• Available methods: PayPal or Bank Transfer

• Minimum withdrawal amount: $200 MXN

• Maximum per withdrawal: $5,000 MXN

• Processing time: 3-10 business days after approval

7.3 Taxes and Fiscal Responsibilities

• You are responsible for declaring and paying applicable taxes on your income according to the laws of your jurisdiction.

• SoloFansNetwork does not withhold taxes unless expressly required by law.

• We can provide annual account statements for tax purposes upon request.

7.4 Transparency and Reporting

• You can view your revenue, commissions, and payment history in real-time from your Creator dashboard.

• You will receive email notifications about:

- Processed and in-transit payments

- Changes to commission structure (with 30 days' notice)

- Summarized monthly account statements

8. CREATOR RESPONSIBILITIES

As a Creator, you agree to:

✓ Regularly monitor and manage the content you publish.

✓ Immediately report any unauthorized use, copyright infringement,

or identity impersonation.

✓ Strictly comply with:

- This Creator Agreement

- Platform Terms of Service

- Privacy Policy

- Applicable local, national, and international laws

✓ Keep your contact information and payment methods up-to-date

to receive notifications and withdrawals.

✓ Not use the Platform for fraudulent, misleading, or harmful

activities toward other users.

9. SPECIFIC PROHIBITIONS FOR CREATORS

The following are strictly prohibited:

❌ Uploading content involving minors under any circumstances (zero tolerance, mandatory reporting to authorities).

❌ Publishing non-consensual material, hidden recordings, or content obtained through coercion.

❌ Infringing copyright, trademarks, or third-party intellectual property without valid license.

❌ Impersonating other creators, celebrities, or institutions.

❌ Engaging in spam, harassment, discrimination, or hate speech toward other users.

❌ Attempting to manipulate the Platform's revenue system, referrals, or metrics.

❌ Distributing malware, malicious links, or engaging in social engineering.

❌ Bypassing Platform security, verification, or moderation measures.

⚠️ Violation of these prohibitions will result in:

• Immediate suspension and/or permanent termination of your account

• Withholding of pending funds pending investigation

• Potential legal action and reporting to competent authorities

10. TERMINATION OF AGREEMENT

10.1 By the Creator

• You may terminate this Agreement at any time by closing your account via: Settings > Account > Delete.

• It is recommended to withdraw available funds before deletion.

10.2 By the Platform

SoloFansNetwork may suspend or terminate your access immediately,

without prior notice, if:

• You materially breach this Agreement or our policies.

• You engage in illegal, fraudulent, or harmful activities.

• We receive valid reports of rights infringement or inappropriate conduct.

• Your account presents security or operational risks.

10.3 Effects of Termination

• Licenses granted for content previously acquired by users will remain valid according to their purchase terms.

• We retain the right to keep information required by law (tax records, fraud prevention, compliance).

• Provisions that by nature must survive (intellectual property, indemnification, limitation of liability) shall remain in effect.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SoloFansNetwork, its affiliates, officers, employees, and agents, against any claim, demand, damage, or expense (including reasonable attorney fees) arising from:

• Your breach of this Agreement or our policies.

• Content you upload, publish, or promote on the Platform.

• Violation of third-party rights (intellectual property, privacy, image, etc.).

• Fraudulent, negligent, or illegal conduct in using the Platform.

12. MODIFICATIONS TO THE AGREEMENT

• The Platform reserves the right to modify this Agreement periodically to reflect legal, technological, or operational changes.

• We will notify you of material changes through:

- A prominent notice in your Creator dashboard

- An email to your registered address

- Updating the "Last Updated" date

• Your continued use of the Platform after changes constitutes acceptance of the updated terms.

• If you do not accept a modification, you may terminate your account before the changes take effect.

13. GENERAL PROVISIONS

13.1 Entire Agreement

• This Agreement, together with our Terms of Service, Privacy Policy, and published policies, constitutes the entire agreement between you and SoloFansNetwork.

13.2 Severability

• If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

• Our failure to exercise or enforce any right shall not constitute a waiver of such right.

13.4 Assignment

• You may not assign or transfer this Agreement without our prior written consent.

• SoloFansNetwork may assign this Agreement in connection with a merger, acquisition, or corporate restructuring.

13.5 Governing Law and Jurisdiction

• This Agreement is governed by the laws of [Mexico / Applicable Jurisdiction].
